SIMPLIFIED PROCESS

FOR CRIMINAL CHARGES

Navigating a criminal law matter involves several stages within the court system. It is crucial to engage a lawyer promptly upon being charged by the police or when facing potential criminal charges. Upon being charged, a police officer may release you with certain conditions or detain you for a bail hearing, depending on the severity of the charges. Mr. Nagi, with extensive experience in conducting bail hearings, can handle both straight and reverse onus bail hearings effectively. The typical steps in a criminal case include:

Hiring a Lawyer

It is imperative to enlist the services of a skilled criminal defense lawyer who is prepared to take matters to trial for optimal outcomes. When hiring a lawyer, provide all relevant details, as memories may fade over time, and trials often occur months after the charge date.

Identification

Following the charge, the police will schedule an appointment for fingerprinting and other identification procedures as per the Identification of Offenders Act. It is essential to attend this appointment to avoid additional criminal charges.

Disclosure

Obtaining all necessary disclosure is the next step. Mr. Nagi will meticulously review the disclosure and request any additional disclosure items as needed. The Crown is responsible for providing first-party disclosure items, while third-party disclosure may require an application, which Mr. Nagi can assist with.

Court Appearance

Upon retaining, CSNLAW will represent you in court. While your presence in court may not be mandatory, Mr. Nagi will notify you if your attendance is required by the judge. It is essential for the defendant to appear at trial.

Resolution

Before proceeding to trial, Mr. Nagi will engage in negotiation discussions with the Crown attorney. The case outcome will be influenced by factors such as the strength of the Crown’s case, Charter breaches, legal defences, etc.

Trial

Based on client instructions, Mr. Nagi will either resolve the matter or proceed to trial. Simple charges like Driving Impaired can be resolved in a day, while more complex cases such as Sexual Assault may require a longer trial duration, potentially exceeding a week.
